Terms & Conditions
These terms and conditions (the “Terms and Conditions”) govern the use of
https://mindhealthtransformation.com.au/ (the “Site”). This Site is owned and operated by Mind
Health Transformation. This Site is an ecommerce website.
By using this Site, you indicate that you have read and understand these Terms and Conditions and
agree to abide by them at all times.
General
Hypnosis is entirely natural, safe, and relaxing. You will remain conscious and in complete control throughout. In hypnosis, the person may be regressed back to childhood memories to help discover the root cause of the issues. Then the client and Jo will work together in hypnosis to get an understanding of where the belief, behaviour originated, with the view to changing it.
Please note, hypnosis alone is no guarantee of success. The client needs to want the change and be open and willing and motivated to want the change via hypnosis. It is crucial that the client listen to the personalised recording made by Jo for 21 consecutive days.
The information, techniques, methods, recommendations by Joanne Clarke are not intended to substitute for the diagnosis and care by a qualified physician/GP, nor to encourage the treatment of illness by persons not recognisably qualified. If you use hypnosis and are under medical care for ANY condition, do NOT adjust ANY prescribed medication without the approval of your doctor. If in any doubt, you should seek your GP’s advice.
Fees
A single package includes a session up to 2.5 hours; personalized recording; 2 follow-up emails and 1 follow up call after 21 days; 100% payment due when booking a session (Cancellations with a 48 period will incur a 50% charge of the session payment). If you are receiving the complete breakthrough package, you will need to commit 100%. If you decide you want to hold onto your limiting beliefs and decide not to complete this package, there will be no refund given.
The client confirms:
- That you are not suffering from any diagnosed psychiatric condition, psychological illness or epilepsy and are not under the supervision of a psychiatrist.
- That you will take part in all sessions free from the influence of either alcohol or drugs and will provide a list of any prescription medicines you are currently taking.
- That you understand and accept that the hypnotherapist may terminate the session without warning if the hypnotherapist should determine that the session has been booked for some purpose other than to receive therapy. If that should this occur, the client will remain liable for any session fee paid in advance.
For purposes of remote, online Zoom hypnosis sessions you, the Client, confirm:
- That you will ensure that the environment in which sessions are undertaken shall be safe and free from distractions and will inform the hypnotherapist if there is anyone else present or monitoring the session.
- That you have provided the correct address and contact details of your online location, with a back-up number or text arrangement in case of technology failure and a third-party emergency contact number.
- That you will not record the session (either by sound or visual means) without prior permission from the therapist.
- If the online connection is dropped while the client is in session, the client will re-activate the call. Jo will inform the client when recording begins, and if a recording has started, the client will wait for Jo to reactivate the call.
- Zoom is the preferred software because of its privacy settings and stability. Prior to the session, the client should ensure Zoom works on their device. The client should be in an upright position (a recliner is perfect). If headphones/microphone are available that helps improve communication.
Caution: Epileptics are generally advised not to enter hypnosis, nor is anyone with a diagnosed psychotic illness.
DO NOT listen to your personalised recording while driving.
All client data is kept strictly confidential. Records will be destroyed after 6 months.

When you create an account on our Site, you agree to the following:
1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and
2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site. The following goods are available on our Site:

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Payments

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the
right to cancel or reverse your transaction.
Consumer Protection Law
Where the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
Mind Health Transformation and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless Mind Health Transformation and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by the laws of the State of New South Wales.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
